This application, for grant of anticipatory bail, arises out of Revelganj P.S. Case No. 154 of 2016, disclosing offences under Sections 188, 147, 148, 149, 153(A), 323, 324, 307, 337, 338, 332, 333, 353, 504 and 506 of the Indian Penal Code. There are twenty six persons, named in the First Information Report, who were allegedly raising slogans against a particular faith/religion. It is also alleged that at one point of time, they became agitated and started pelting stones. The police, on chase, arrested twelve persons, who disclosed the names of other co-accused including these petitioners who had participated
Patna High Court Cr.Misc. No.44606 of 2016 (2) dt.28-10-2016 2/2 alongwith them.
Learned counsel for the petitioners, has submitted that there is no specific allegation of any overt act against these petitioners and the allegations are general and omnibus. Considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - VIII, Saran at Chapra, in connection with Revelganj P.S. Case No. 154 of 2016, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
