The Petitioner who is in custody seeks bail in connection with Madhepura P.S. Case No. 265 of 2017 registered for the offence punishable under Sections 406, 467, 468, 420 of the Indian Penal Code and Section 66 of the Information Technology Act.
It has been submitted on behalf of the petitioner that the petitioner has committed no offence and on mere suspicion he has been falsely implicated in this case. It has been submitted on behalf of the petitioner that till date no T.I.P has been conducted. It has been further submitted that similarly situated co-accused person namely Uttam Kumar Jaiswal has been granted bail by a co-ordinate bench of this Court vide
Patna High Court Cr.Misc. No.38789 of 2017(2) dt.19-08-2017 2/2 order dated 20.07.2017 passed in Criminal Miscellaneous No. 33644 of 2017. The petitioner has got no criminal antecedent and is in custody since, 06.05.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S.
