JUSTICE SANJAY PRIYA ORAL ORDER 10-10-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bariarpur P.S. Case No. 71 of 2018 instituted for the offence under Sections 366 and 364 of the Indian Penal Code.

It is alleged in the written report that daughter of the informant aged about 21 years has been kidnapped by the petitioner.

Counsel for the petitioner submits that victim girl has been examined under Section 164 Cr. P.C. The statement of victim girl is available in the case diary wherein she has stated that she knew the petitioner from before. Petitioner has performed marriage with her. She lived with him for one day. Medical report of the victim girl has been enclosed as

Patna High Court Cr.Misc. No.55700 of 2018 (3) dt.10-10-2018 2/2 Annexure-2 wherein the Doctor has not found any injury on the person of the victim girl. The Doctor has opined the age of victim between 19 to 20 years.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Bariarpur P.S. Case No. 71 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
