ANJANA MISHRA ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Ara (Town) P.S. Case No.329 of 2016 for allegedly having committed the offence under Sections 341, 323, 308, 427 and 379/34 of the Indian Penal Code. Learned counsel for the petitioner submits that there is case and counter case between the parties and the injuries sustained on both sides. The allegation against the petitioner is that he assaulted the informant on his head with butt of the pistol. The injuries have been found on parietal region and it is stated that they are simple in nature.
Considering the nature of allegation and that there is
Patna High Court Cr.Misc. No.49875 of 2016 (2) dt.20-12-2016 one case against the petitioner under the Excise Act and that there is a history of previous disputes, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur (Ara), in connection with Ara (Town) P.S. Case No.329 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
