Petitioner, who is in custody, seeks bail in connection with Ariyari P.S. Case No. 70 of 2015 registered for the offences punishable under Sections 341, 323, 325, 379, 307, 337, 338, 504 and 34 of the Indian Penal Code and under Section 27 of the Arms Act.
Allegation against petitioner is firing upon the informant as a result of which he sustained injury on his left thumb.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case due to land dispute. Petitioner has earlier moved to another co-ordinate
Patna High Court Cr.Misc. No.58710 of 2018(3) dt.25-10-2018 2/2 Bench of this Court for bail vide Cr. Misc. No. 39244 of 2018 which was rejected on 09.07.2018 with a liberty to renew his prayer for bail after framing of charge. It has been further submitted that charges has been framed. Petitioner is in custody since 02.06.2018.
Considering the aforesaid facts and circumstances of the case and the observation made in order dated 09.07.2018 passed in Cr. Misc. No. 39244 of 2018, petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial, Sheikhpura in connection with Ariyari P.S.
