2. The petitioner is in custody in a case registered for the offence punishable under Sections 272 and 273 of the BNS and Section 30(a) of the Bihar Prohibition & Excise (Amendment) Act, 2022.
3. As per allegation in the FIR, total 842.25 liters of country made liquor has been recovered from a truck bearing registration no.CG04HB3288 and also XUV vehicle bearing registration no.BR-01PB-8788.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that nothing has been recovered from the conscious
Patna High Court CR. MISC. No.43492 of 2026(2) dt.08-07-2026 2/2 possession of the petitioner nor the petitioner is the owner of the said two vehicles and he has no concern for the recovery of the seized liquor and he is in custody since 15.05.2026.
5. Learned APP for the State opposes the prayer for bail of the petitioner.

In view of the aforesaid submissions as made by learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-II, Samastipur in connection with Shahpur Patori (Patory) P.S. Case No. 109 of 2024.
