NILU AGRAWAL ORAL ORDER 07-09-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner, by this application has sought modification of the order dated 22.06.2016 passed in Cr. Misc. No. 21263 of 2016 wherein Petitioner no. 3 Md. Najruddin S/o Abdur Rahman has been granted anticipatory bail.

It has been submitted by the learned counsel for the petitioner that the petitioner could not surrender in the Court below within the stipulated period of eight weeks as his Parvikar never informed him about the said order. Hence seeks extension of further four weeks time to surrender before the Court below. Prayer is allowed.

Let the petitioner, above named in the event of his arrest / surrender before the learned court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.38719 of 2016 (2) dt.07-09-2016 each to the satisfaction of the learned Judicial Magistrate (Railway) 1st Class, Samastipur in connection with DBG (SMI) Case No. 23 of 2016 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.

This modification application is allowed to the extent indicated above.
