Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Bikram P.S. Case No. 343 of 2021 lodged under Sections 379/420 of the I.P.C. and 66 (c) of I.T. Act. As per the prosecution case, the total Rs. 1,84,999/- has been debited from the account of the accused with the help of tool computer of the petitioner Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He submits that the computer of the petitioner may be used as tool but the

Patna High Court CR. MISC. No.42471 of 2022(3) dt.05-12-2022 2/2 said tool was directly under control of the co-accused Akash Raj, with whom petitioner was alleged to live. Learned counsel for the petitioner submits that the entire money was utilized by the said co-accused. He further submits that petitioner is in custody since 30.03.2022 having clean antecedent. Charge-sheet has already been filed in this case.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned ACJM VI, Danapur, Patna in connection with Bikram P.S. Case No. 343 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
