2. The petitioner seeks regular bail in connection with Budha Colony P.S. Case No. 674 of 2022, registered for the offence punishable under Sections 363 & 366 of the Indian Penal Code later added Section 376 of the Indian Penal Code and Section 6 and 6 of the POCSO Act.

3. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The victim was abducted by the petitioner. From reading of the 164 Cr.P.C. it appears that it was the girl who appears to be major has eloped willingly with the petitioner. Petitioner is in custody since 04.01.2023.

4. Learned APP has vehemently opposed the prayer

Patna High Court CR. MISC. No.42600 of 2023(2) dt.14-07-2023 2/2 for bail.

5. Considering the nature of allegation and period of custody, this application is allowed.

6. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-VI-cumSpecial Judge, POCSO, Patna, in connection with Budha Colony P.S. Case No. 674 of 2022.
