JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-11-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 498A and 379/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The prosecution case is that the informant claims to have been married with the petitioner on 11.03.2015 when `50,000/- cash and ornaments were given but further demand of `60,000/- was made and when the same was not fulfilled, the informant was assaulted.

It is submitted by learned counsel for the petitioner that the petitioner was kidnapped and taken to the temple and forced to marry with the informant but the petitioner escaped from captivity and gave his fardbeyan on 13.03.2015 which came to be registered as a police case being Bibhutipur P.S. Case No. 49 of

Patna High Court Cr.Misc. No.51055 of 2015 (2) dt.04-11-2015 2/2 2015 on 20.03.2015. Subsequently, the petitioner also filed Complaint Case No.201 of 2015 against the informant's family. It is submitted by learned counsel for the informant that the factum of marriage is not being denied by the petitioner and if the factum of marriage is not denied then offence under Section 498A IPC is made out.

Considering the case lodged by the petitioner at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Samastipur in connection with Mahila P.S. Case No. 11 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
