This is a petition for grant of regular bail for offences under Sections 363, 366(A) and 34 of the Indian Penal Code in connection with Rauta P.S. Case No. 14/2016, corresponding to S.Tr. No. 113/2017.

Earlier prayer for bail of the petitioner was refused by this Court vide Cr. Misc. No. 15864/2017 for the reason that the victim-girl, who was kidnapped, had alleged that the petitioner committed rape against her. During the trial arising out of Rauta P.S. Case No. 14/2016, corresponding to S.Tr. No. 113/2017, the victim has turned hostile as she has not supported what she had stated before the learned Magistrate under Section 164 of the

Patna High Court Cr.Misc. No.41388 of 2017 (2) dt.06-09-2017 2/2 Cr.P.C. Other prosecution witnesses have also been examined in this case.

Learned trial court is directed to conclude the trial within a period of four months from the date of receipt of a copy of this order, failing which, the petitioner would be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to his own satisfaction in connection with Rauta P.S. Case No. 14/2016.
