JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Kochas P.S. Case No. 11 of 2019 registered for the offences punishable under Sections 406 and 409 of the Indian Penal Code.

Prosecution story is that pursuant to the direction of this Court in CWJC No. 15459 of 2014 Panchayat Secretary of Gram Panchayat, Gara and Kuchhila were directed to submit the documents in relation to appointment of Panchayat Teachers. However, the petitioner, who is at present Panchayat Secretary of Gram Panchayat Kuchhila and Gara has not deposited the document. Submission of learned counsel for the petitioner is that petitioner took charge of Gara and Kuchhila Panchayat in 2017 and the folder of certificates have not been handed over to him by the earlier Panchayat Secretary and he has informed about the same to

In view of above facts and circumstances, let petitioner surrender in the court below by 5.7.2019 and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Rohtas at Sasaram, in connection with Kochas P.S. Case No. 11 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that he has to co-operate with the authorities and also the I.O. and produce the papers available to him as called for by the authorities as well as I.O.

With the above observation, this application is disposed of.
