Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks regular bail in connection with Sonpur P.S. Case No. 309 of 2022 registered for the offence punishable under Section 379 of the Indian Penal Code.

As per the prosecution, the informant's motorcycle was stolen by some unknown miscreants from the alleged place. The main submissions advanced by learned counsel Mr. Anant Kumar Bhaskar, appearing for the petitioner are that the petitioner has clean antecedent and he has been languishing in jail since 30.05.2022 and he was arrested on 28.05.2022 but he

Patna High Court CR. MISC. No.43181 of 2022(2) dt.23-11-2022 2/2 was produced before the court below for remand on 30.05.2022. Learned APP appearing for the State has opposed the prayer for bail.

Heard both the sides and perused the FIR and the order impugned. Though as per the order impugned, the stolen motorcycle was recovered from the possession of this petitioner but considering his clean antecedent and custody period and also the fact that the alleged offence is triable by First Class Magistrate, in the opinion of this Court the petitioner deserves to a lenient approach of this Court. Accordingly, let the petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Sonpur P.S. Case No. 309 of 2022.
