Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
This application for anticipatory bail arises out of Pandaul P.S. Case No. 28 of 2020 for the offence under Sections 25(1-b)a/26/35/37 of the Arms Act.
It is contended by learned counsel for the petitioner that the only allegation against this petitioner is that he was traveling with the main accused on the motorcycle and he has no role in the occurrence. It is further contended by learned counsel for the petitioner that other similarly situated accused persons have been granted anticipatory bail.
Learned APP for the State has submitted that
Patna High Court CR. MISC. No.9585 of 2021(2) dt.07-12-2021 2/2 though other accused persons have been granted anticipatory bail but this petitioner has three criminal antecedents and there is a case registered under the Excise Act which goes to show that the petitioner was involved in this case also. Considering the above, in my opinion, this is not a fit case for grant anticipatory bail to the petitioner. Accordingly, this bail application is dismissed.
The petitioner is directed to surrender before the Court below within a period of four weeks from today. (Sandeep Kumar, J) pawan/- U T
