The petitioners, 10 in number, apprehend their arrest in Bihta P.S. Case No. 67/16 registered under Section 307 and other sections of the Indian Penal Code.
Informant Vishal Kumar alleged that he was in possession of the land of Khata No. 264, Plot No. 192 and Khata No. 164, Plot No. 191 but the accused persons including the petitioners came and began to fix poles on the land of the informant on the order of Lalan Yadav. Pappu Yadav fired from his licensee gun. Ram Pravesh Yadav is said to have
Patna High Court Cr.Misc. No.39939 of 2016 (2) dt.21-09-2016 2/2 assaulted the informant with iron rod. It is submitted that there is a case and counter-case. From the side of the petitioners, Bihta P.S. Case No. 66 of 2016 is registered against the father of the informant and others. Vishal Kumar (the informant), who is alleged to have been assaulted by Ram Pravesh Yadav, got simple injury. The maternal aunt of the informant also got simple injury. Nobody was injured in the firing.
Considering the facts aforesaid and the fact that there is a case and counter-case and the injured have sustained simple injuries, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Danapur, District Patna in Bihta P.S. Case No. 67/16, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
