JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-02-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Suryagarha P.S. Case No.17 of 2017 for the offence under Sections 420 and 120B of the Indian Penal Code and Sections 30(a), 32© and 38(D) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that earlier petitioner has approached this Court in Cr. Misc. No. 85891 of 2019. Prayer for bail was rejected vide order dated 19.02.2019. Petitioner is in custody since 23.09.2019.

Considering the fact that the petitioner has remained in custody for more than one year, the Court is inclined to grant

Petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge-II-cumSpecial Judge, Lakhisarai in connection with Suryagarha P.S. Case No.17 of 2017.
