The sole petitioner, apprehending his arrest in Govindganj ( Malahi) P.S. Case No.120 of 2016 registered for the offence under Sections 272, 273 of the Indian Penal Code and Section 47(A) of the Excised Act, has prayed for grant of bail , in the event of his arrest.
It was submitted by learned counsel for the petitioner that the petitioner has falsely been made accused on an accusation of recovery of 55 liters of toddy and one liter of country-made liquor. Learned counsel for the petitioner submits that the petitioner was having no connection with the seized

Learned Addl. Public Prosecutor has opposed the prayer for anticipatory bail of the petitioner. However, keeping in view the nature of accusation, let the petitioner, Sharma Chaudhary , in the event of his arrest or surrender within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Govindganj ( Malahi) P.S. Case No.120/2016, subject to conditions as laid down in Section 438 (2) of the Code of Criminal Procedure.
