The petitioner seeks regular bail in connection with Kadirganj P.S.Case No.76 of 2016 registered for offences punishable under Sections 147,148, 149, 341, 342,323,325, 307, 379, 302 of the Indian Penal Code.
Allegation is against 28 persons including the petitioner of assault by lathi and danda due to which the deceased succumbed to the injuries.
Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and another co-accused person has been granted bail by a Co-ordinate Bench of this Court, vide order dated 10.11.2017 passed in Cr. Misc. No.52089 of 2017. The petitioner is in custody since
Patna High Court Cr.Misc. No.55540 of 2018 (3) dt.01-10-2018 2/2 7.6.2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist class, Masaurhi, Patna in connection with Kadirganj P.S.case No.76 of 2016 With following conditions :
(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and in the event of failure to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.
