The petitioners apprehend their arrest in a case under Section 366A, 120B of the Indian Penal Code.

The informant alleged that Md. Mokhtar kidnapped his minor grand daughter. The informant named Md. Amin and Md. Alamgir. Md. Alamgir disclosed that his grand daughter would not return. Md. Alamgir is brother-in-law of Md. Mokhtar. The victim is still traceless and there is specific allegation against Md. Alamgir that he helped Md. Mokhtar in kidnapping and concealing the victim.

Considering the nature of allegation made against the

Patna High Court Cr.Misc. No.31046 of 2015 (3) dt.07-10-2015 2/2 petitioner No.2, I am not inclined to enlarge Md. Alamgir, petitioner No.2, on anticipatory bail. Accordingly, the same is rejected.

So far as Ajmeri Khatoon, petitioner No.1, and Sayara Khatoon, petitioner No.3, are concerned, there is no specific allegation against them. Ajmeri Khatoon is wife of petitioner No.2, Md. Alamgir and Sayara Khatoon is mother of Md. Alamgir.

Considering the facts aforesaid, the petitioner No. 1, Ajmeri Khatoon, and petitioner No.3, Sayara Khatoon, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Minapur P.S. Case No. 139 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
