JUSTICE RAKESH KUMAR ORAL ORDER 02-09-2016 Heard Sri Vibhakar Kumar, learned counsel for the petitioners and Sri Surendra Prasad Singh, learned A.P.P. Two petitioners apprehending their arrest in Kotwali Adampur P.S. Case No. 85 of 2016 registered for the offence under section 409/ 420 of the Indian Penal Code, have prayed for bail in the event of their arrest or surrender. It was submitted by learned counsel for the petitioners that petitioners had joined as Panchayat Secretary in the year 2012 and there was no occasion for the petitioners to commit the crime in the present case. He has also argued that in almost similar circumstances other accused persons have been granted the privilege of anticipatory bail.
Patna High Court Cr.Misc. No.34473 of 2016 (2) dt.02-09-2016 2/2 The court is of the opinion that keeping in view the fact that petitioners are the main named accused persons in such offence there is no necessity to pass an order for granting the privilege of anticipatory bail which is to be extended not in normal condition.
The petition stands dismissed.
