The petitioner seeks bail in a case registered for the offence punishable under sections 302, 201, 34 of IPC. Vide order dated 24.08.2022, a report was called for, regarding the stage of trial. In compliance thereof, a report sent by learned Additional Sessions Judge-13th, Vaishali at Hajipur, dated 01.09.2022, kept at flag 'R', whereby it is submitted that out of 10 chargesheet witnesses, eight witnesses have been examined, and other two witnesses are yet to be examined in this case. Summons have been issued against the prosecution witnesses. The next date fixed for prosecution evidence is 07.09.2022.

Considering the submissions made in the report, I am not inclined to grant bail bail to the petitioner named above. The

Patna High Court CR. MISC. No.43179 of 2022(3) dt.21-09-2022 2/2 prayer for bail is hereby rejected.

Accordingly, the bail application is dismissed. However, the trial court is directed to conclude the trial as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order and if trial is not concluded within the stipulated time, petitioner shall be released on bail by the Court below itself.
