ANJANA MISHRA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Kurhni P.S. Case No.129 of 2012 for allegedly having committed the offence under Sections 406, 409, 384 and 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation against the petitioner is false and mischievous as he has no role to play in the opening of the account of the recipients of Indira Awas Yojana. He further submits that it was the Branch Manager and the B.D.O., who have actually effected the transaction and not this petitioner. Considering the aforementioned facts and

No.29715 of 2015 (3) dt.07-10-2015 2/2 circumstances and that the petitioner has no role to play, as stated by the learned counsel for the petitioner, and also in view of the fact that this petitioner has one other case instituted against him after the present case in which he has already been granted anticipatory bail by this Court, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Kurhni P.S. Case No.129 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
