JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 22-12-2016 After some argument, the learned counsel appearing on behalf of the petitioner, in presence of the learned State counsel appearing on behalf of the respondent nos.1 to 3, seeks permission to withdraw the present writ petition with a liberty to raise all the issues of facts and law with respect to the lands in question before the Director of Consolidation, Bihar, Patna where the matter is still sub-judice.

Permission is accorded.

The writ petition stands disposed of as withdrawn with the liberty aforesaid.

The learned counsel appearing on behalf of the petitioner raises a valid grievance that the Consolidation Revision

Patna High Court CWJC No.17034 of 2014 (2) dt.22-12-2016 Case No.95 of 2009 is pending there for more than 7 years and, therefore, an appropriate direction may be issued for disposal of that matter at an early date.

In view of the aforesaid submissions, the respondent Director of Consolidation, Bihar, Patna is directed to take up that matter on priority basis and all endeavours shall be made to dispose of the same at an early date preferably within a maximum period of six months from the date of receipt/production of a copy of this order. However, before passing any final order, an opportunity of hearing must be given to the petitioner as also the private respondent nos.4 to 8, besides others, if any.
