2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 414, 309, 120(b) of the Indian Penal Code.

3. As per the prosecution case, this petitioner committed theft of construction materials.

4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his named transpired during course of investigation. No incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery.

5. However, learned A.P.P. for the State opposed the bail application and submitted that name of the petitioner transpired during course of investigation and he has got three
