====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-07-2024 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 504/34 of the Indian Penal Code.
3. As per prosecution case, petitioner No. 1 gave lathi blow on head of informant, and when he fell down, petitioner No. 2 gave lathi blow on the hand of informant causing fracture. Petitioners claim clean antecedent.
4. In view of the fact that petitioner No. 2 caused grievous injury, prayer for anticipatory bail of petitioner No. 2 is refused. However, considering the simple nature of injury
Patna High Court CR. MISC. No.45116 of 2024(2) dt.29-07-2024 2/2 caused by petitioner No. 1, the anticipatory bail with regard to petitioner No. 1 is allowed and it is ordered that the above named petitioner No. 1 in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IX, Gopalganj in connection with Uchakagaon P. S. Case No. 461 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
