Earlier prayer for bail of the petitioner has been rejected by this Court vide order dated 28.02.2017 passed in Cr.Misc. No.9177 of 2017 with a direction to the trial court to expedite the trial.
Submission of the learned counsel for the petitioner is that uptil now the case has not been committed to the court of Session and a report called for has been received from the court of A.C.J.M.-6, Danapur, that the petitioner has not been produced before me from the custody and the trial court has already written to the Jail authority for production of the accused. In such view of the matter, hence, District Magistrate, Patna is directed to see that accused is produced in court on next
Patna High Court Cr.Misc. No.49038 of 2017 (3) dt.08-11-2017 2/2 date and the court below is directed to commit the case to the court of Session within a period of two months. At the same time the learned District and Sessions Judge is directed to see the commitment of the case to the court of Sessions. On commitment of case, the trial court is directed to conclude the trial within a period of nine months from date of commitment and the Sr.S.P. is directed to see the production of the witnesses in the court on the date fixed in the trial.
