The petitioner apprehends his arrest in Kurtha P.S. Case No. 93/2015, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. Some altercation took place in regard to chips of mobile on which the petitioner is alleged to have assaulted the informant with lathi on his head. Co-accused Sandeep Kumar is alleged to have assaulted informant with lathi on his back. Other accused persons also assaulted him and his family member. It is submitted that the informant got simple injuries on head and other parts of body. Some verbal altercation took place in which there was scuffle and the informant got injuries. No offence is made out against the petitioner under Section 307 of the

Patna High Court Cr.Misc. No.45623 of 2016 (2) dt.24-11-2016 2/2 Indian Penal Code.

Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner above-named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Arwal in connection with Kurtha P.S. Case No. 93/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
