JUSTICE BIRENDRA KUMAR ORAL ORDER 03-12-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 467,468,471 of the Indian Penal Code and 30,30(a),38,41 of Bihar Prohibition and Excise Act, 2016.

Petitioner No.1-Rajesh Kumar is owner and petitioner No.2- Sunil Kumar Yadav is said to be driver of the Pick-Up Van on which huge quantity of liquor was recovered.

Considering the nature of allegation against the petitioners, I am not inclined to enlarge them on anticipatory bail in connection with Masrakh P.S.Case

Patna High Court Cr.Misc. No.56103 of 2018(4) dt.03-12-2018 2/2 No.251 of 2018 pending in the court of learned 6th A.D.J., Saran Chapra.

Hence, prayer is refused.

Petitioners are directed to surrender within three weeks.
