JUSTICE RAKESH KUMAR ORAL ORDER 19-08-2017 Heard Sri Niranjan Parihar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 12.06.2017 in Kiul Rail P.S. Case No.124/2017 registered for the offence under Sections 30(a), 38(1) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail. Learned counsel for the petitioner submits that the petitioner was not at all aware about the fact that under the seat of the train, there was huge quantity of country-made liquor , but the petitioner was arrested on accusation as if he was owner of the seized articles. Learned counsel for the petitioner, by way of referring to the statement made in paragraph-3 of the petition, submits that the petitioner is having clean antecedent and has remained in custody for sufficient time.

No.39609 of 2017 (2) dt.19-08-2017 2/2 Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner, namely, Ramesh Ray be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Lakhisarai in connection with Kiul Rail P.S. Case No.124/2017.
