The petitioners seek bail in anticipation of their arrest in connection with Tiyar P. S. Case No. 50 of 2020, dated 23.07.2020, instituted for the offences

Patna High Court CR. MISC. No.38623 of 2020(2) dt.27-04-2021 2/3 under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

It appears from the prosecution report that 147.20 litres of liquor was recovered from forest and the accusation against the petitioners is only that they were found standing near the community hall.

There is no recovery from the exclusive possession of the petitioners and they have no criminal antecedents.

The petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge cum Special Excise Act Court or concern Court, Bhojpur at Ara, in connection with Tiyar P. S. Case No. 50 of 2020, subject to the
