The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 354, 379, 504, 506 and 34 of the Indian Penal Code read with Section 3 and 4 of the DAAIN Act.
Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is aged about 75 years and the informant alleges that this petitioner assaulted her with iron rod on the ground that she is a daain. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and even presuming what has been alleged is true, without admitting the same for the purposes of bail, then the injury suffered by the
Patna High Court CR. MISC. No.53222 of 2021(2) dt.21-06-2022 2/2 informant though is on the vital part of the body but is simple in nature and the blow is not repeated and the petitioner is an old man aged about 75 years.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sakari P.S. Case No. 30 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
