Mr. Khurshid Anwar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 10-11-2022 Heard learned senior counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 448, 354, 379, 307 and 504 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioner no.1 has antecedent of one case and rest of the petitioners are persons with clean antecedent and petitioner nos.

Patna High Court CR. MISC. No.42756 of 2022(2) dt.10-11-2022 2/3 2, 3, and 5 are young boys of 19 years of age. Learned counsel for the petitioner submits that the informant alleges that petitioner no.1 tried to outrage the modesty of his sister but she managed to escape, further on 06.04.2022, the accused persons, including the petitioners, came to his house and assaulted his family members on account of which three persons received injuries and also took away jewellery and anklet.

Learned senior counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted that allegation of assault is general and omnibus in nature, further the allegation of attempting to molest is nothing but to give serious colour to the case, it is next submitted that from side of the petitioners Karpi (Shahar Telpa) P.S. Case No. 73 of 2022 was instituted against the side of the informant, it is also submitted that even the injuries suffered by the injured are simple in nature, as would be evident from Annexure-3 series to the supplementary affidavit which has been filed today which is taken on record, it is also submitted that from side of the petitioners also persons have suffered injuries.

Learned A.P.P. for the State opposes the prayer for

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Karpi (Shahar Telpa) P.S. Case No. 72 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Shivam/- U T
