2. The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 30(D)/30(a) of the Bihar Prohibition and Excise (Amendment) Act.
3. 70 litres of Mahua liquor has been recovered from the Devi Asthan. The petitioners have been made accused only on suspicion. The petitioner No. 1 has got clean antecedent whereas petitioner No. 2 has two criminal antecedent of similar nature.
4. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.
5. Considering the facts and circumstances of the case and
Patna High Court CR. MISC. No.42241 of 2025(2) dt.07-07-2025 2/2 submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within eight weeks from today, the petitioner No. 1 (Jitendra Yadav) be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, III, Patna in connection with Masaurhi P.S. Case No. 439/2020, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
6. So far as the prayer for anticipatory bail of the petitioner No. 2 (Arun Kumar) is concerned, it is rejected.
