The grievance of the petitioners in the present application for non-consideration of the case of the petitioners for grant of A.C.P, although the petitioner claimed that petitioner is entitled to grant such promotion.

It appears from Annexure-12 that the petitioners have filed representation to the Director Higher Education, Patna for

Patna High Court CWJC No.17866 of 2014(2) dt.06-09-2018 2/2 grant of A.C.P. of the petitioners dated 10.11.2013 has not been disposed of as yet.

Under the aforesaid circumstance, the Director Higher Education, Patna is required to decide the claim of the petitioner for grant of the A.C.P. and if similarly circumstanced others have been granted such benefit, the Director Higher Education, Patna shall ensure similar treatment extended to the petitioners in the light of the litigation policy 2011. Final decision in this regard may be taken by the respondent within a maximum period of the four months from the date of receipt/production of a copy of this order.
