The petitioner is languishing in custody since 26.05.2017 in a case for the offence registered under Section2s 195, 406, 420 and 120(B) of the IPC.
The prosecution story, in brief, is that some miscreants looted the truck loaded with turmeric qand other spices worth Rs. 40,00,000/- after intoxicating him. It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. The charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has been made accused in the present
Patna High Court Cr.Misc. No.42834 of 2017 (2) dt.20-09-2017 2/2 case due to mistake of fact. He has been made accused in the F.I.R. on the basis of the statement made by the co-accused. No wrongful gain or loss has been made on the part of the petitioner. The other co-accused has been granted bail by this Court vide Cr. Misc. No. 42790 of 2017.
On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Daudnagar, Aurangabad in connection with Daudnagar P.S. Case No. 121/2017.
