Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 307, 379, 504 506, 34 of the Indian Penal Code.

It is alleged that all the accused persons

Patna High Court CR. MISC. No.38974 of 2020(5) dt.21-12-2021 2/3 including the petitioner assaulted the informant and his friend Lucky Kumar. It is alleged against this petitioner that he assaulted the informant with Chabania which hit on the left eye of the informant.

It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated due to village politics. The injury report of the informant has been attached along with the case diary which suggests the injuries to be simple in nature. Moreover, other similarly situated co-accused persons have been granted anticipatory bail from the Court below itself. A statement has been made in para 3 of the petition that though the petitioner is accused in two other cases apart from the present one, but he is on bail in those cases. In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands)
