JUSTICE BIRENDRA KUMAR ORAL ORDER 20-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners are languishing in custody for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Some unknown person committed murder of the father of the informant by bitterly assaulting him. The F.I.R. is against unknown.

The impugned order reveals that during investigation suspicion has been raised against the petitioners and others on the ground that only the petitioners and others were present in the campus where occurrence took place. Hence, they

Considering the fact that only suspicion is there against the petitioner, he is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City, Patna/Successor Court, in connection with Fatuha P.S.
