2. A prayer for bail has been made on behalf of the petitioner in connection with Bidupur P.S. Case no.217 of 2025 registered under section 317(4) and 317(5) of BNS, 2023.

3. Allegation in the F.I.R is that there is recovery of one motorcycle from the possession of petitioner and one coaccused Ravi Kumar.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the case. No incriminating article has been recovered from the conscious or physical possession of the petitioner. Only a mobile phone is said to have been recovered from his possession. Patna High Court CR. MISC. No.41558 of 2025(3) dt.12-02-2026 2/2 Kumar has been granted the privilege of regular bail by this Court vide order dated 28.07.2025 passed in Cr. Misc. No. 44105 of 2025. The petitioner is in custody since 21.03.2025 and undertakes to cooperate in the case/trial.

5. The application for bail is opposed by learned A.P.P. for the State.

6. Taking into consideration the aforesaid facts and circumstances of the case and also considering the period of custody coupled with the fact that similarly situated co-accused has already been granted bail by the aforesaid order dated 28.07.2025, the petitioner is directed to be enlarged on bail in connection with Bidupur P.S. Case no.217 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned where the case is pending/successor Court.
