The petitioner seeks regular bail in Parsauni P.S. Case No.69 of 2016 for the offence under Section 302/34 of the Indian Penal Code.
Allegation against the petitioner is of committing murder of his wife.
Submission of the learned counsel for the petitioner is that whatever allegation is that there is allegation against the mother of the petitioner and not against him and it is also evident from the record that there was scuffle in between the mother of the petitioner and the deceased, so, she committed suicide. Post mortem report also reveals the cause of death of deceased Mira
Patna High Court Cr.Misc. No.33965 of 2017 (3) dt.04-08-2017 2/3 Devi due to asphyxia leading to cardiac- respiratory failure due to hanging. Further submission is that this petitioner is in custody since 23.11.2016 and other co-accused persons have already been granted bail by the court below as well as by a coordinate Bench of this Court as contained in para 13 of this petition. Heard the learned A.P.P. also who apposed the prayer for bail of the petitioner.
Having heard both sides and in view of the facts and circumstances and the other accused persons have been granted bail including the mother of the petitioner against whom there is allegation of scuffle with the deceased have been granted bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M.,-VII, Sitamarhi, in Parsauni P.S. Case No.69 of 2016 subject to the conditions that (i) one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court. (ii) The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required
