Petitioner is alleged to have taken away motorcycle of the doctor from his nursing home bearing Registration No.BR34H-5238. Contention on behalf of petitioner is that he along with informant happens to be resident of same place. Having some sort of strained relationship among them, he has been named otherwise being neighbour, he would have been arrested on the same day and in similar fashion, the motorcycle could have been recovered from his possession. The real fact is that motorcycle was taken away by unknown thief and in the aforesaid background, has been named. It has also been submitted that

Patna High Court Cr.Misc. No.47615 of 2017 (02) dt.09-11-2017 petitioner happens to be under custody since 15.07.2017. That being so, petitioner, Kariya Yadav @ Prashant Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P. S. Case No.447 of 2017.
