Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in connection with Govindganj (Malahi) P.S. Case No. 85 of 2001 registered for the offence under Sections 147, 148, 149, 323, 324 and 302 of the
Patna High Court CR. MISC. No.41944 of 2025(3) dt.03-09-2025 2/3 Indian Penal Code.
3. As per the prosecution case, the petitioner is an accused in a case of murder.
4. The petitioner is in custody since 8.2.2025 and it has been submitted by the learned counsel for the petitioner that the petitioner was exonerated by the police after investigation but the Magistrate has taken cognizance against the petitioner.
5. Considering the aforesaid facts, this application is allowed.
6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Addl. Sessions Judge-II, East Champaran, Motihari/concerned Court below in connection with S.Tr. No. 297 of 2025 arising out of Govindganj(Malahi) P.S. Case No. 85 of 2001.
7. After being released on bail, the petitioner is directed to cooperate in the trial by appearing personally till the framing of charge, if the charge has not already been framed and after framing of charge he is directed to cooperate in the trial either by appearing personally or through his lawyer. Noncompliance of the condition will result in cancellation of the bail

2. The petitioner seeks bail in connection with Govindganj (Malahi) P.S. Case No. 85 of 2001 registered for the offence under Sections 147, 148, 149, 323, 324 and 302 of the Indian Penal Code.
3. The petitioner is named in the FIR and there is allegation against him of assaulting the victim. There are seven injuries on the dead body of the victim and charge-sheet was also submitted against the petitioner.
4. The petitioner is in jail since 24.02.2025 and he is an absconder in a case of year 2001.
5. In view of the aforesaid facts, this Court is not inclined to grant bail to the petitioner.
