JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 17-01-2018 The petitioner who happens to be the husband of the informant is said to have assaulted the informant and snatched away her two children arriving at her maternal house. When the informant approached the petitioner and demanded her children, he took her to his house and keeping there assaulted her. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. As a matter of fact, the petitioner wants to keep the informant with him, but it is the informant who lives in higher society in Patna and does not want to live with the petitioner at his house and suo motu left her children and performed second marriage with some other person. Injury found on the person of the informant is on non-vital part i.e. on arm and simple in nature. Notice was sent to
Patna High Court Cr.Misc. No.26544 of 2017 (9) dt.17-01-2018 2/2 the informant through learned lower court but after receiving the notice, the informant did not turn up before the Court. The petitioner is on provisional bail. Earlier the petitioner has faced incarceration of five months.
In the facts and circumstance, the provisional bail of the petitioner is hereby confirmed. The petition is disposed of accordingly.
