JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 25-10-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Katihar Muffasil P.S. Case No. 117 of 2016 registered under Sections 341, 323, 324, 504, 307, 379 and 34 of the Indian Penal Code.
The accusation is that when the informant was going to his house for prayer, 4 persons, including the petitioners came on the way and started abusing. At that time, both petitioners caused injury at the head and arm of the informant through sword and farsa. In the meantime, Kaili took out cash Rs. 10,000/- from his pocket. When his son-in-law rushed to save him, he was also assaulted by the petitioners.
Patna High Court Cr.Misc. No.44402 of 2016 (2) dt.25-10-2016 2/2 Learned counsel appearing on behalf of the petitioners submits that in fact, son of the informant was married with the daughter of petitioner no.1 Md. Narul, but the informant was not satisfied with the marriage of his son and due to that reason, hot talk were exchanged and with ulterior motive, this present case is lodged by the informant. Moreover, the four injuries, as found on the person of the informant, are of lacerated in nature.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Katihar in connection with Katihar (Muffasil) P.S. Case No. 117 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
