The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 04.03.2017 passed in Cr. Misc. No. 4621 of 2017, on the ground that the petitioner is in custody since 09.09.2016, FSL report has not been received up-till now, seizure list witnesses are not supporting the alleged seizure, uptill now no prosecution witness has been examined though charges have been framed on 30.03.2017 and as such the petitioner deserves sympathetic consideration. Learned counsel representing SSB opposes the prayer of bail.
In the facts and circumstances stated above, finding no good ground for reconsideration of the prayer of bail, again his such prayer stands rejected.
Patna High Court Cr.Misc. No.49642 of 2017(2) dt.18-10-2017 2/2 However, learned trial court is directed to expedite the trial and conclude the same as early as possible, preferably within six months from the date of receipt/production of a copy of this order after taking the same on priority basis, failing which the petitioner, if at no fault, may be at liberty to renew his prayer of bail.
