Petitioner seeks bail in Udwant Nagar P.S. Case No. 244 of 2017 registered for the offence punishable under Sections 304(B), 201/34 of the Indian Penal Code.

Informant who is father of the victim has alleged that one year before he married his daughter to the petitioner and thereafter she was being subjected to torture for non fulfillment of demand of dowry and on 19.08.2017 he came to know that his daughter was killed.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case and the relation between husband and wife was cordial. It has been further submitted that the parties have arrived at compromise

Patna High Court Cr.Misc. No.56079 of 2018(4) dt.17-01-2019 2/3 and compromise petition has been annexed as Annexure-2. Similarly, situated co-accused persons have been granted bail by co-ordinate benches of this Court vide orders dated 15.01.2018 in Criminal Miscellaneous No. 2511 of 2018, 08.02.2018 in Criminal Miscellaneous No. 6689 of 2018, 27.04.2018 in Criminal Miscellaneous No. 23822 of 2018 and 26.04.2018 in Criminal Miscellaneous No. 24556 of 2018. Petitioner has got no criminal antecedent and is in custody since 21.12.2017. Informant has appeared in this case and has stated that he has no objection if bail is granted to petitioner. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs.

10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Arrah, in connection with Udwant Nagar P.S. Case No. 244 of 2017, with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. (S. Kumar, J) ranjan/- U
