The petitioner seeks regular bail in connection with Kankarbagh P.S. Case No. 229 of 2019, registered for the offence punishable under Sections 447, 448, 420, 406 and 471/34 of the Indian Penal Code.

The allegation is regarding the petitioner and other accused persons having taken money from the informant and others with the promise for providing job, but thereafter, the accused persons had failed to provide any job. The learned counsel for the petitioner submits that the petitioner is having a clean antecedent and he is languishing in custody since 28.2.2019. It is further submitted

No.39542 of 2019(4) dt.17-08-2019 2/2 that the petitioner is ready to deposit cash security of Rs. 50,000/- for the purposes of grant of bail and the fact is that he has been falsely implicated in the present case. The learned counsel for the informant has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, I deem it fit and proper to direct for release of the petitioner on bail, subject to deposit of a sum of Rs. 50,000/- in the Nazarat of Patna Civil Court whereupon the petitioner shall be released on bail on such conditions as may be deemed fit and proper to be imposed by the learned Judicial Magistrate 1st Class, Patna in connection with Kankarbagh P.S. Case No. 229 of 2019.

The present petition stands disposed of on the aforesaid terms.
