2. The petitioner seeks regular bail in connection with Patauna P.S. Case No. 43 of 2024 registered for the offence under Sections 126(2), 115(2), 64(2), 352, 351(2) of the B.N.S.

3. As per the prosecution case, the petitioner is accused of committing rape with the victim and assaulting her.

4. Learned counsel for the petitioner submits that it is a case of consensual relationship and when a co-villager saw them in forest, this false case was registered. He further submits that the trial has also not progressed. The Medical report does not support the prosecution case and the statement of the victim. The petitioner is in custody since 20.07.2024.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, period of custody, medical report and the fact that the trial has been delayed, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Benipatti, District Madhubani/concerned Court below in connection with Patauna P.S. Case No. 43 of 2024.
