JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-10-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506 and 307/34 of the Indian Penal Code. The prosecution case is that the petitioners came to the house of the informant and in the background of land dispute, abused and assaulted the informant and when the wife and daughter-in-law of the informant came to rescue they were also assaulted.

It is submitted by learned counsel for the petitioners that in the background of land dispute, general and omnibus accusation has been levelled. There is counter version of the occurrence also

Patna High Court Cr.Misc. No.37759 of 2015 (4) dt.08-10-2015 2/2 when the petitioners' side also received injuries. It is submitted by learned counsel for the informant that the informant and his wife received grievous injury. The informant is 70 years old where his wife is 65 years old. Considering the nature of accusation, this Court is not inclined to interfere.

Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Chhabilapur P.S. Case No. 69 of 2015 pending in the court of learned CJM, Nalanda at Biharsharif. Accordingly, the application is disposed of.
