JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Harsidhi P.S. Case No. 108 of 2021, registered for the offence punishable under Section 302 and 34 of the Indian Penal Code and section 27 of the Arms Act.

As per the FIR, this petitioner along with other coaccused fired five times on the body of informant's husband which hit on his chest, head and neck and he died on the spot. It is further alleged that 5-6 years ago, petitioner demanded Rangdari from husband of informant for which he lodged criminal case and due to old animosity this occurrence took place.

Petitioner is in custody since 16.03.2021. Counsel for the informant however, vehemently opposed the prayer for bail and submitted that petitioner is main assailant of the deceased.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner abovenamed on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
