JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-09-2017 The petitioner seeks regular bail in connection with Sahar P.S. Case No. 88 of 2016, registered for offences punishable under Sections 304B/34 of Indian Penal Code.
Petitioner is husband and allegation against the petitioner is causing dowry death of the deceased.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and entire prosecution story is not probable as had the petitioner killed the deceased he would not have kept the dead body in his house. Further he has been in judicial custody since 18.10.2016.
Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not
Patna High Court Cr.Misc. No.42127 of 2017 (2) dt.12-09-2017 inclined to release the petitioner on bail, his application for regular bail is, accordingly, dismissed.
However, it appears that charge has been framed in this case and two witnesses have already been examined, as such, the trial court is directed to expedite the trial and try to conclude it within a period of seven months.
